I have dedicated my career as a lawyer fighting for the underdog. I spent many of my years as a tenacious criminal defense lawyer at the Orange County and San Bernardino Public Defender's Offices. Fighting for the underdog, I gained a tremendous amount of experience in the courtroom. With 24 jury trials under my belt, I possess the litigation skills necessary to fight for you and get the results you deserve. Follow these steps so you can bulletproof your case!
While at the scene of a car wreck (and if possible), be sure to (1) take pictures and videos of the damage; (2) get the other driver's name and insurance information; (3) get the contact information for any witnesses; (4) call the police so they can create a police report; and (5) avoid saying that you're "fine" because your adrenaline may prevent you from feeling any injuries that you may have.

After a doctor puts you on a treatment plan, it's important that you stick to it.

In 99% of my cases, I wait until AFTER the client is done treating to settle their personal injury case.
This is because I don't want to settle your case prematurely, which is a major mistake that people without personal injury lawyers make.
The last thing you want to do is settle a case and THEN it turns out that your injuries are worse than anticipated (the horror stories are real with this one!).
Unfortunately, in those situations, any future medical bills will not be paid by the at-fault insurance company because you only get one bite at the apple.

What if the insurance company is accepting liability?
It's all downhill from here, right? That's not necessarily the case. There are two parts to every car wreck case. The first part is getting the insurance company to accept liability. The second part (and often the hardest part) is getting the insurance company to pay the right amount of money to compensate you. Let's find out what that amount is.
Is a lawsuit necessary?
While I love going to court, I love maximizing a client's recovery and getting them paid super fast even more. So the goal is always to resolve a client's case without ever filing a lawsuit. But once I hear more about your case, I can better tell whether a lawsuit is necessary.

It does not. Typically, cases with only property damage and no bodily injury can be resolved without the need for a lawyer. If you're having issues getting your property damage resolved, then please reach out to a firm that handles property-only cases.
A number of things, which is why you should talk with a lawyer!
The most common is that any delay in getting medical treatment can definitely hurt your case.
Also, any gap in treatment (e.g. you miss several weeks of treatment) will hurt your case. In both situations, the insurance company will argue that you weren't that hurt because if you were, then you would have received treatment earlier or wouldn't have missed days.
As a result, the insurance company will give you low-ball offers. If these situations apply to you, then that doesn't mean you don't have a case. Things will just be tougher, which is why an experienced personal injury lawyer should be consulted.
For personal injury cases, this firm handles them on a contingency-fee basis. In other words, the firm is only paid if a resolution is reached. If a resolution is reached prior to a lawsuit being filed, then the firm receives the standard 1/3 of the recovery (less expenses). If a resolution is reached after a lawsuit is filed, then the firm receives the routine 40% of the recovery (less expenses).
The goal is always to keep expenses low and to resolve the case without the delay and expenses that come with litigation. But, in some situations, litigation is required, which then requires much more work from the firm (hence the 6.7% increase in fees).
Unfortunately, this firm cannot give medical advice. Therefore, at a minimum, you should talk to a doctor because the last thing you would want is for your body to heal incorrectly, which can cause long-term issues.
